New Delhi: After setting out implementation of the national eligibility entrance test (NEET) as the single window exam for admission in all medical colleges, the Supreme Court said on Thursday that private medical colleges cannot conduct counselling for admission to MBBS and BDS courses.

The admission process, the court said, would be done through centralised counselling conducted by the state governments concerned. This means that educational institutions will not be able to reach out to prospective students through "offer letters" on the basis of NEET results.

The court passed the order on a petition filed by the Madhya Pradesh government seeking contempt proceedings against private colleges which, it said, were defying the SC order by holding their own counselling for admission in MBBS and BDS courses.

The order has wider application as private colleges in other states are also conducting counselling which has been challenged in the court.

"If any counselling has been done by any college or university and any admission has been given so far, such admission shall stand cancelled forthwith and admission shall be given only as per centralised counselling done by the state government," a five-judge Constitution bench said. The SC, however, refused to pass any punitive order against the colleges on the contempt plea and allowed them to send their representatives to participate in the counselling process.

After the Supreme Court recently stayed an order of the Bombay High Court allowing deemed universities to conduct admissions to their medical courses, parents are anxious about the fate of their children. The matter is listed for further hearing in the SC for September 20.
“NEET (National Eligibility Entrance Test) is a good move, but after 20 days of undergoing counselling sessions in various colleges in different states, my daughter was shortlisted and admitted to Bharati Vidyapeeth Deemed University’s medical college. Classes have begun after a delay of more than two months when the DMER (Director of Medical Education and Research) has now objected to the deemed universities holding their own counselling process and not through the government body. Now, we will have to wait for the SC order,” says a worried parent.
On August 30, the HC had stayed the Maharashtra government’s decision mandating centralised counselling for students who appeared for NEET this year for medical and dental courses and allowed deemed universities in Maharashtra holding their own counselling sessions for admissions.
The court made it clear that the deemed universities shall admit students strictly on basis of rankings in NEET. However, the SC later stayed the Bombay HC order and the matter is now listed for September 20.
“Uncertainty continues to prevail despite students now availing of admissions at various medical and dental colleges under eight deemed universities in the state,” said Vivek Saoji, Dean of Bharati Vidyapeeth deemed university’s medical college.
When contacted Dr Pravin Shingare, director of Medical Education and Research, said the admissions to medical colleges at deemed universities would be cancelled if the SC ruled in our favour.
After HC order, DMER to complete admission to unaided private medical colleges Dr Shingare said admissions to the MBBS course in private unaided medical colleges would be completed as soon as possible following Monday’s order of the Bombay High Court, which declined to the interfere with the National Eligibility Entrance Test (NEET).
Monday’s HC order came on a petition that challenged the Maharashtra government’s new domicile rules providing reservation of seats in unaided private medical colleges for local students. The petitioners had sought exemption for private medical colleges saying they wanted to go ahead with the admissions on the basis of the NEET. But the state government insisted on strict compliance of new domicile rules discarding NEET ranks, Dr Shingare pointed out.
According to Dr Shingare, the state government told the HC bench of Chief Justice Manjula Chellur and Justice MS Sonak that the new rules were formulated to protect the interests of the local students. The state government also pointed out that there were nine states with similar domicile policies. “We will now complete the admissions to the colleges soon,” Dr Shingare said.

The Supreme Court, on 16 September, stayed an order of the Bombay High Court that allowed Deemed to be Universities to conduct admissions to medical courses.
The apex court stayed the 30 August, 2016, order of the Bombay HC till Monday, 19 September. It further listed the matter before the Constitution bench, where similar matters are pending.
While passing the interim order, a bench comprising of Justices Shiva Kirti Singh and R Banumathi, said that prima facie the HC should not have stayed orders of the Centre and the Maharashtra government.
Meanwhile, the UGC on 15 September, passed a notification stating all Deemed Universities will have to conduct medical admissions on basis of NEET 2016 Merit List.
Meanwhile, the UGC on 15 September, passed a notification stating all Deemed Universities will have to conduct medical admissions on basis of NEET 2016 Merit List.
According to the apex court: "Prima facie, we are of the view that the High Court should not have stayed the orders issued by the State of Maharashtra and the Union of India dated August 20, 2016 and August 9, 2016 respectively. Hence the impugned order passed by the Bombay High Court is stayed till the next date of hearing.
"We direct both the parties to maintain status quo prevailing as on date. List these matters on Monday i.e. September, 19, 2016 ... before the Constitution Bench where similar matters are pending."
While issuing notice on the appeal filed by Maharashtra government challenging the high court order, the bench said, "We have considered the broader contour of the controversy and the orders by which this court permitted centralised examination through NEET and also the judgment of the Constitution Bench..."
The high court had on 30 August stayed the Maharashtra government's decision, mandating centralised counselling for aspirants who appeared for the National Eligibility Entrance Test (NEET) this year for MBBS and BDS courses. The court allowed deemed universities in Maharashtra to hold their own counselling sessions for the admissions.
Private deemed universities running medical and dental colleges, had moved the High Court against a government resolution(GR) which provides for centralised counselling for admissions.
The High Court had stayed the mandatory common counselling, but made it clear that the deemed universities shall admit students strictly on the basis of the ranking in NEET.
The state government had contended that centralised admissions process makes it easier for students as they do not have to apply separately to each college.
There are around 1,600 medical seats in deemed universities in Maharashtra.

The Directorate of Medical Education and Research (DMER) will announce the final Maharashtra- Common Entrance Test (MH-CET) results on Wednesday, June 1.

While students are aware of their individual scores after their OMR sheets were made public last week, the results will give a clear idea on how many students will be eligible for medical and engineering seats in the state.
On May 24, the DMER had released the optical mark reader (OMR) sheets of 3.97 lakh candidates who had appeared for the MH-Common Entrance Test on May 5.
Based on the question paper and answer key of the examination, students can easily find out their final scores and 17-year-old Rishab Rawat from Mumbai has topped the medical stream with a perfect 200.
This year, a sudden U-turn by the Supreme Court on the compulsion on medical and dental aspirants appearing for the National Eligibility-cum-Entrance Test (NEET) instead of state-based Common Entrance Tests had left many students worried.
Since MH-CET follows the state board syllabus and NEET follows CBSE, students were worried that they’ll have to go through the entire CBSE syllabus in two months to be able to appear for NEET in July.
However, an ordinance approved and signed by President Pranab Mukherjee last week stated that only this year, students aiming for government-run MBBS and BDS institutes can use the MH-CET scores, while NEET will be the only marks to be considered for admissions to private and deemed universities.
Next year onwards, NEET will be the only entrance examination considered for admissions to all medical and dental institutes across the country.
At Date 1st June 2016 you can check the MH-CET Result.
